From the article: TORONTO — Crown prosecutors have upgraded the charge against a man accused of attacking Oasis guitarist Noel Gallagher at a Toronto music festival.
Forty-seven-year-old Daniel Sullivan is now charged with one count of aggravated assault — he was originally charged with assault.
Aggravated assault can carry a maximum sentence of 14 years in prison whereas the maximum penalty for assault is five years.
Last September at the Virgin Music Festival, a man ran onto the stage during Oasis’ performance and tackled Gallagher from behind.
In a media interview after the incident, Gallagher said he suffered three broken and dislodged ribs after falling onto his speakers.

When this fool walks out of jail at 61 years old, I hope he realizes why 14 years of his life has been wasted for such an act of such stupidity. 15 mins of fame, was it really worth 14 years in jail? Hope he enjoys life behind bars

I doubt he will get 14 years or anywhere near that. He will probably get like 6 months in jail, with a few years probation. Could be different if he has a record, but I don't see him getting much more.

I would have agreed with you if the charge was for simple assault. I mean with a max of 5 years he may have got 6 months and some community service, or probation, but there must be a reason that the prosecution bumped up the charge to the more serious "aggravated assault".
I'm thinking he'll either plead guilty to the lesser charge, which will guarantee him jail time (which could be a couple years), as opposed to a trial for this more severe charge. But who knows with this nitwit what he will do.

yeah the judicial system is messed up i mean this guy is suppose to get 14years but like guigs & matt said he's lucky to do 6 months to a year with probation probably only a year?prisons are soo over crowded thats all they seem to do these days no matter how terrible the crime!solution cyanide tables in prisoners dessert pudding that will clear thing out}  . |

It wasn't just a simple slap or punch, the guy was responsible for breaking Noel's ribs. Furthermore, it could have been a lot worse than that. 14 years would be way too much, but 6months is not long enough. You need to use this as an example to let other assholes know that they can't get off lightly for assaulting someone in a similar way. On a side note, it really bothers me why the average citizen who decides to smoke weed, or whatever, can get more jail time than someone like Sullivan who assaults a celebrity. It simply makes no sense. |

l4e, if the guy wanted to kill noel, he had a very, very clear opportunity to. this was obviously just a spur of the moment action done by an idiot.
furthermore, idiots will be idiots. they don't think before they do stupid things. how will a harsh jail sentence prove a point if those imbeciles don't think in the first place?
and i completely agree with the whole pot thing, although it doesn't mean shit that noel's a celebrity. the guy assaulted another person.

I think Noel's celebrity should hold some bearing on proceedings. It will depend if the guy has any previouis. Also if he missed a court hearing or changed his plee that should go against him as being indecisive. I am guessing 2.5 Years for the fooker though.

The minimum term is 5 years. Even if they cut half that off with parole thats still 2 and half to 3 years.

To be fair, he can also be charged with trespassing along with assault. If you run onto the field of a baseball game or football pitch, you're gonna be charged even if you didn't assault or do anything else.
Oh and public intoxication is a crime, too (a really stupid law, but it's nevertheless on the books).

There is no way the guy should get the jail for what he did. Yes he was a complete tit for doing what he did, but getting the jail for pushing somebody over is just a tad over the top.

It's not the same as a bar fight, he ran up on stage (which is a restricted area) and pushed someone from behind unexpectedly, breaking his ribs. If he ran up to Noel man to man on the street and hit him, that would be different. He'd still be an idiot, but Noel would have been able to defend himself. |
